Axis Privacy Policy

1.0 Introduction

Axis Forestry Inc. is a forestry equipment manufacturing company based in Kamloops, British Columbia, Canada. Our innovative tree-processing equipment are connected to our enterprise-built computing tablets and software that help to record the volume of trees cut on job-sites, and to help measure the productivity of your workforce in terms of output. In order to better serve our customers, we have developed a privacy policy and privacy management program that governs how we process personal data from anyone using our equipment and systems.

We strive to comply with the following data privacy protection laws:

As a private-sector company headquartered in British Columbia, Canada, we strive to comply with both the applicable Federal and Provincial laws that govern how to handle process information in our possession. We also strive to comply with the GDPR due to the diverse and far-reaching nature of our international customer base.

 

2.0 What Personal Data Does Axis Collect?

We collect the following personal data in order to provide you with services. We collect the following types of personal data from you:

Website Purchasing Name, Email Address, Phone Number, Billing / Payment Information (e.g., Credit Card Number) To collect and process orders of our goods and services and ship our products to you or your company.
Cypress Tablet (Job Site) Operator Name, Hours Worked, Productivity (Volume), Jobsite Name / Location To connect our machines with our app, so that we may record productivity for you to review with your team.
Game of Processing (App) Operator Name, Mobile Number, Email Address, Work History (Volume, Hours, Productivity), Geolocation, Operator Image / Likeness, GPS, IP Address, Device Signals (Bluetooth signals, IP address, Wi-Fi access points, beacons, cell towers) To allow jobsite operators to measure work history and volume, and to locate them on jobsites to assist in occupational health and safety requirements. The productivity also helps workers measure and encourage their productivity.


We will never use, disclose, or store any personal data from you which is not directly connected to the original purpose for which we collected that data from you. If we intend to collect personal data for purpose which differ from the original reason why we ask you for the information, we will contact you to obtain your express consent.

 

3.0 How or When Does Axis Collect Personal Data?

We collect personal data in the following ways:

4.0 How Will Axis Use Personal Data?

The following chart shows, at-a-glance, how and why we use personal data:

Provide optimal web browsing and App user experience We configure our site and the App to ensure that our sites operate optimally.
Promotional Materials We periodically tailor our products, services, and offerings to you to determine how we can best meet your company’s business needs.
Measuring Work Volume We gather intel on work volume on job sites to determine overall worksite productivity, which we then provide in aggregated (de-identified) reports to our clients.
Record User Work Activity We use the work volume of end users so that they can see their overall activity. End users (such as users of the App) can then compare their goals and accomplishments with others on a purely voluntary basis.
Worker Health, Safety, and Connectivity We use geolocation and GPS to locate workers on job sites to assist in occupational health and safety by determining if an employee is on a job site and, if necessary, to locate them in case of an emergency.


 

5.0 Does Axis Share Personal Data with Others?

Axis works with third-party vendors and service providers to support the business and ensure that our operations and services run smoothly. We disclose or share personal data if those vendors need the information for purposes such as analyzing our website performance and efficiency, provide customer service, process payments, host data (through IT security storage or infrastructure), and / or to conduct marketing exercises or surveys. If we share or disclose personal data which is not consistent with the original purpose for which we collect your personal data, we will first obtain express consent from you prior to doing so.

Your information is shared with others in the following ways:

Website visitors: geolocation, IP address, connectivity Third-party analytics will receive a limited amount of your interactions with our site to measure its efficiency and to understand the geographics of our customers.
Website purchasers: credit card information and billing (e.g., home) address Third-party payment providers will receive your credit card information in order to process payment and complete purchase transactions.
Purchasers: delivery address and contact information Third-party courier or delivery company receive delivery address in order to deliver product to your offices / premises
Work productivity / history End user / operator work product and history will be disclosed to the operator’s employer to track overall productivity on job sites.
GPS / Geolocation Third-party telecommunications companies will ping your GPS or geolocation in order to locate users, connect them to our system, and provision access to the Axis software on our tablets.
Communicate with our Clients We contact our customers to promote our products, remind them of any necessary renewals or outstanding payments, and obtain feedback so that we may improve our operations and products.


Additionally, all data at Axis is supported by and backed up in Amazon Web Services’ Canadian and U.S. operations. Please read Part 6 below for more information on how AWS and Axis comply with applicable data privacy laws.

 

6.0 Location of Data Processing and Storage

6.1 Location

We store your information with Amazon Web Services (AWS), using both their Canadian and American servers. The storage of your personal data in Canada is compliant with the EU’s adequacy decision recognizing that Canadian data privacy laws are sufficient to safeguard EU data subject personal data. We also store a limited amount of personal data at AWS’s US servers, which is permitted due to AWS having all proper data protection measures in place, in compliance with the data sovereignty and transfer requirements under the General Data Protection Regulation (GDPR). 6.2 Storage

Axis will retain your personal data for at least one (1) year after its use has been exhausted or after your account has been terminated. This will permit you to submit a request to access a copy of the personal data on file, in compliance with the applicable sections of GDPR, PIPEDA, and PIPA.

EU residents have the right, at any time, to request that Axis deletes their personal data under GDPR. This is subject to any exceptions to erasure permitted in GDPR. Please refer to Part 8.0 below for more details.

 

7.0 How Can I Manage the Personal Data I Provide?

Axis stores personal data for:

  • As long as it is necessary (as required by law) to retain it; or
  • At least one (1) year after your account is deleted, so that you may access your data upon request.

We will determine if there are any other requirements to retain personal data for longer periods, such as due diligence, applicable laws or regulations, or other legal or compelling reasons (such as litigation hold or under a court order) to continue keeping it.

You may direct us to delete your personal data by contacting our privacy officer (see Part 9 for contact details). However, such deletion is not automatic, and we may need to retain some or all of your personal data if permitted or required to continue providing you with services or if required to be retained by applicable law.

 

8.0 GDPR Rights (for EU Residents)

If you are a resident of the EU, you have additional data subject rights under the General Data Protection Regulation (GDPR). Your data privacy rights are as follows:

  • Right of Access to Information (Article 15): You have the right to obtain a copy of your personal data from Axis. We may charge you a small fee for processing this request.
  • Right to Rectification (Article 16): You have the right to rectify or correct any personal data we have collected about you if it is factually incorrect or inaccurate. You also have the right to ask us to complete any personal data about you that is incomplete.
  • Right of Erasure (to be Forgotten) (Article 17): You have the right to direct us to delete your personal data. This right of erasure is limited, however, as we reserve the right to retain your personal data in compliance with applicable laws or court orders. Please note that this right does not apply to any personal data that is necessary to continue to provide you with our services.
  • Right to Restrict the Processing of Data (Article 18): You have the right to direct Axis to restrict the processing of your personal data, subject to certain restrictions. Please note that this right does not apply to any personal data that is necessary to continue to provide you with our services.
  • Right to Object to Processing of Data (Article 21): You have the right to object to the processing of your personal data, subject to certain restrictions. Please be advised that once we have received your objection, we will stop processing your data, but it may severely limit our ability to provide you with goods and services. Please note that this right does not apply to any personal data that is necessary to continue to provide you with our services.
  • Right of Portability (Right 20): You have the right to direct us to provide you a copy of your personal data, and to transfer that personal data to the entity of your choice. All data sets and records in data portability requests shall be provided in a common, machine-readable format.

If you wish to exercise your data subject rights, please submit your request in writing. We will endeavour to respond to your request within 30 calendar days. Please note that if your request is unclear, we will contact you to seek additional clarification, and the time to respond will not run until have obtained such clarification from you. If you make an access request and there is a large volume of personal data to gather, or you make several requests within a short period of time, we reserve the right under GDPR to take a two-month extension to fully respond to your request(s).
